JUSTICE VINOD KUMAR SINHA ORAL ORDER 01-02-2018 Petitioner apprehends his arrest in connection with Kotwali P.S.Case No. 558 of 2017 registered for the offences under Sections 341, 323, 504 and 353/34 of the Indian Penal Code.

Allegation against the petitioner is of creating obstruction in vehicle checking and collecting fine and petitioner is not named in the FIR.

Submission of learned counsel for the petitioner is that he has not been named in the FIR and there is no recovery from him and he is not owner of motorcycle and he has falsely been implicated in this case.

In the facts and circumstances, let the petitioner, above

Patna High Court Cr.Misc. No.3926 of 2018 (2) dt.01-02-2018 2/2 named, in the event of his arrest or surrender, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Gaya, in connection with Kotwali P.S. Case No. 558 of 2017, G.R. No. 7990 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and further conditions that (1) one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of court concerned and (2) petitioner will co-operate in investigation and will appear before the Investigating Officer as and when required, except on genuine reason, failing which his bail bond shall be cancelled.
