In this case, the petitioner is seeking anticipatory bail in connection with Bahera P.S. Case No.254 of 2017 (G.R. No.291 of 2017), registered for the offence punishable under Sections 365 and 366(A) of the Indian Penal Code. Allegation has been made that the daughter of the informant, aged about 15 years, was kidnapped by the petitioner for the purposes of marriage. However, the girl in her statement, recorded under Section 164 of the Cr.P.C. has stated that she left the house on account of threat of her life from her father and went to Ludhiyana. From there, she called the present petitioner
Patna High Court Cr.Misc. No.19101 of 2018(2) dt.06-04-2018 2/2 and entered into the marriage with him.
Looking to the aforesaid fact, let the above-named petitioner, be released on anticipatory bail in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) with two sureties of the like amount each to the satisfaction of the A.C.J.M., Benipur, Darbhanga, in connection with Bahera P.S. Case no.254 of 2017 (G.R. No.291 of 2017), subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
