The petitioner has renewed his prayer for grant of bail in a case registered under section 302 of the Indian Penal Code.

The earlier prayer for bail of the petitioner was rejected vide order dated 2.2.2022 (Annexure-1) passed in Cr. Misc. no.36856 of 2021 directing the learned trial Court to expedite the trial.

As per the prosecution case, the petitioner is stated to have assaulted and killed his father. The informant happens to be the step mother of the petitioner.

A report was called for from the learned trial Court. As per the report received contained in letter dated 1.4.2023

Patna High Court CR. MISC. No.3666 of 2023(3) dt.26-04-2023 2/2 from the learned Additional District Judge IX, Kaimur at Bhabua, six out of the seven chargesheet witnesses have been examined and only the Investigating Officer of the case remains to be examined.

Having heard learned counsel for the parties and taking into consideration the nature of allegation against the petitioner, the Court is not inclined to enlarge the petitioner on bail and the application is rejected.

From the report dated 1.4.2023 received from the learned trial Court, it transpires that only the Investigating Officer remains to be examined.

The Superintendent of Police, Kaimur at Bhabua is directed to ensure the appearance of the Investigating Officer of the case for his examination as a witness in the learned trial Court at the earliest, if not already examined. The learned trial Court is directed to expeditiously conclude the trial preferably within a period of six months from the date of communication of this order.
