Petitioner is apprehending his arrest in Giriyak P.S. Case No. 278 of 2017 for the offences registered under Sections 366A and 34 of the Indian Penal Code.

Allegation against petitioner along with another is of kidnapping daughter of informant and another girl while they went to attend the call of nature.

It has been contended on behalf of the petitioner that petitioner is innocent and has not committed any crime. Petitioner has been implicated in this case due to village politics. The victims in their statement recorded under Section 164 of the Code of Criminal Procedure have not stated anything which could rope him in this case. Patna High Court Cr.Misc. No.3477 of 2018(3) dt.17-02-2018 2/2 accused Chandan Manjhi. Except for confession there is nothing against petitioner.

Considering the facts and circumstances of the present case, let petitioner, above named, in the event of arrest or surrender within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bond of Rs.10,000/ (Ten thousand only) with two sureties of the like amount each to the satisfaction of the learned ACJM-Ist, Nalanda, in Giriyak P. S. Case No. 278 of 2017 ,subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
