2. The petitioner seeks bail in connection with Patepur P.S. Case No. 262 of 2025, instituted for the offences punishable under Sections 126(2), 127(2), 140(1), 329(3), 65(1), 3(5) of the Bharatiya Nyaya Sanhita, 2023 and Section 4 of the POCSO Act.

3. The prosecution case, in short, is that the petitioner along with other co-accused person abducted the minor daughter of the informant from her house and committed rape upon her.

4. Learned counsel for the petitioner submits that the

Patna High Court CR. MISC. No.77277 of 2025(3) dt.03-02-2026 2/3 petitioner is innocent and has falsely been implicated in the present case. Charge-sheet has been submitted in this case. Learned counsel for the petitioner also submitted that there is delay of four days in lodging the FIR. It is further submitted that the victim has stated nothing against the petitioner in her statement recorded under Section 183 of the Bharatiya Nagarik Suraksha Sanhita, 2023. The petitioner is in custody since 08.08.2025 and has got one criminal antecedent.

5. Learned APP for the State and learned counsel for the informant have vehemently opposed the prayer for grant of bail to the petitioner.

6. Considering the aforesaid facts and circumstances of the case and taking into account the period of custody undergone by the petitioner, this Court is inclined to grant bail to the petitioner.

7. Let the petitioner be released on bail on furnishing bail bonds of Rs. 15,000/- (Rupees Fifteen Thousand) with two sureties of the like amount each to the satisfaction of Court below/concerned Court in connection with Patepur P.S. Case No. 262 of 2025, subject to the following conditions: (I) One of the bailors shall be own/close member of the family of the petitioner.
