The petitioners apprehend their arrest in Madanpur P.S. Case No.
of 2017, registered under Sections 341,323,308,379,504,506/34 of the Indian Penal Code. The informant alleged that he along with his brother had gone to his field situated near Madanpur Parao to work done in his field. But the accused persons including the petitioners assaulted the informant and his brother.
The learned counsel for the petitioners submits that the no specific allegation of assault is made against the petitioners. Jitendra Kumar, the informant got simple injury, Abhay Kumar Mehta, the brother of the informant got one injury on nose and the opinion is
Patna High Court Cr.Misc. No.5065 of 2018 (2) dt.01-02-2018 2/2 kept reserved. It is further submitted that both the parties have compromised the case.
Considering the facts aforesaid and the nature of allegation made against the petitioners, the petitioners, above named, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Aurangabad (Bihar), in connection with Madanpur P.S. Case No. 250 of 2017, subject to conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
