2. The petitioner has filed the present writ petition seeking the following reliefs:- i. For issuance of writ in the nature of Mandamus directing and commanding the official respondents to remove the illegal encroachment of the petitioer from the private respondent no.7 Vinodanand Pandey, who has encroached the homestead land of the petitioner bearing Thana No.402, Khata No.146, Khesra No.3224, Area about 3 feet part land of 11 dismal, situated at Mauza-Bargaun Village- Bargaun, the said land ancestor property of the petitioner, forcible encroached and dispossessed from over the land. ii. For issuance of writ in the nature of Mandamus directing and commanding the official respondents to

Patna High Court CWJC No.18254 of 2024(2) dt.03-12-2024 2/2 stop the illegal possession over the homestead lands of the petitioner, who has forcible encroached the passage of 3 feet land of house and private respondent forcible not entered into the 3 feet passage of street.

iii. For issuance of appropriate direction to the official respondents to give necessary protection from the action of the private respondent no.7, who have illegally, arbitrarily possessed the part land of house of the petitioner with ill motive, is trying to grab the 3 feet part street area of the petitioner bearing Thana No.402, Khata No.146, Khesra No.3224, Area about 11 dismal, part of said land of 3 feet and encroached the part land of house about 3 feet land of street.

3. Learned counsel for the petitioner submits that the present writ petition may be disposed of with liberty to the petitioner to file petition before the competent forum/ Court for redressal of his grievances.

4. Learned counsel for the State has no objection to this prayer of the petitioner.

5. In view of the submission of learned counsel for the petitioner, the present Writ Petition stands disposed of with liberty to the petitioner, as prayed for.
