2. The petitioners apprehends their arrest in a case in connection with Bhagwanpur P.S. Case No. 194 of 2023, registered for the offences punishable under Sections 341, 323, 324, 354, 379, 307, 504, 506/34 of the Indian Penal Code.

3. As per F.I.R., allegation against the petitioners are of capturing the land of the informant and also abuse and assault the informant side.

4. It is submitted by learned counsel for the petitioners that the petitioners have falsely been implicated in the present

Patna High Court CR. MISC. No.83221 of 2023(2) dt.08-01-2024 2/2 case. Petitioner no. 1, 2 and 5 have got no criminal antecedent whereas petitioner no. 3 and 4 have got two criminal antecedents in which they are on bail mentioned in Para 3 of the bail application. There is Title Suit No. 720/2022 is going on between them. There is no allegation of causing serious injury. So no case under Section 307 of the Indian Penal Code is pending.

5. Learned APP for the State has opposes the prayer for bail.

6. Having regard to the facts and circumstances of the case and also there is Title Suit is going on between the parties, let the above named petitioners, be released on bail, in the event of their arrest, on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending/ successor Court in connection with Bhagwanpur P.S. Case No. 194 of 2023, subject to the condition as laid down under Section 438 (2) of the Cr.P.C. (Anjani Kumar Sharan, J) Ranjeet/- U T
