JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 07-04-2023 At the outset, learned counsel for the petitioner seeks permission to withdraw this anticipatory bail application with respect to petitioner No. 2 as he has already been arrested during pendency of the case and thus, his bail application has become infructuous.
Permission is granted.
Anticipatory bail application with respect to petitioner No. 2 namely, Sudhir Narayan Chaudhary @ Sudhir Chaudhary is dismissed as withdrawn.
Heard the parties.
Petitioner No. 1 apprehends arrest in a case registered for the offences punishable under Sections 341, 323, 326, 307/34 of the Indian Penal Code.
As per F.I.R., all the accused persons including this
Patna High Court CR. MISC. No.4758 of 2023(2) dt.07-04-2023 2/2 petitioner armed with deadly weapons assaulted the informant and his family members.
Learned counsel appearing for the petitioner submits that petitioner is innocent and has falsely been implicated in this case. He next submits that specific accusation of assault is against co-accused Amandeep Chaudhary and co-accused Shubhash Chaudhary. So far this petitioner is concerned, allegation is general and omnibus. Case and counter case. Petitioner is a lady and claims clean antecedent. Considering the aforesaid facts and circumstances, let the above named petitioner in the event of her arrest/surrender before the court below within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-I, Sherghati, Gaya in Sherghati P. S. Case No. 593 of 2022, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
