JUSTICE VINOD KUMAR SINHA ORAL ORDER 27-02-2018 Petitioner apprehends his arrest in connection with Surypura P.S.Case No. 11 of 2017 registered under Sections 377/34 of the Indian Penal Code and 4/6 of POCSO Act. Allegation against the petitioner is of committing unnatural offence with the son of the informant, who is a minor. Submission of learned counsel for the petitioner is that statement of the victim has been recorded under Section 164 Cr.P.C. in which he has not stated regarding unnatural offence, rather he has stated that some ugly talks were made with him. Further submission is that co-accused has been granted privilege of anticipatory bail by a co-ordinate Bench of this Court vide order dated 18.12.2017 passed in Cr.Misc.No. 58029 of 2017. Heard learned APP also.

No.10754 of 2018 (2) dt.27-02-2018 2/2 Having heard both sides and in view of facts and circumstances, let the petitioner, above named, in the event of his arrest or surrender, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions JudgeI, Rohtas at Sasaram, in connection with Surypura P.S.Case No. 11 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and further conditions that (1) one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of court concerned and (2) petitioner shall co-operate in investigation and appear before the Investigating Officer as and when required, except on genuine ground, failing which his bail bond shall be cancelled.
