The petitioner has filed the instant application for grant of regular bail in a case registered for the offences punishable under Sections 399, 402/34 of the Indian Penal Code and Section 25(1-B)a, 26, 35 of Arms Act.

On the basis of secret information of assembling of miscreants, informant, being a police official, raided a place and apprehended 5 persons and rest fled away. On search, one country made pistol and

No.85036 of 2023(2) dt.09-01-2024 2/3 2 live csrtridge has been recovered from the possession of co-accused Suraj Kumar and one country made pistol and two empty cartridge has been recovered from the possession of co-accused Prasanjit Vats @ Dipu. Petitioner and others are alleged to have been fled from the place.

It is submitted by learned counsel for the petitioner that the petitioner is innocent and he has falsely been implicated in the present case. Neither the petitioner was apprehended on spot nor anything incriminating has been recovered from his conscious possession. The name of petitioner sprang up in this case on the confession of apprehended co-accused person, before the police, which got no evidentiary value in the eye of law. Moreover, the petitioner is languishing in judicial custody since 27.02.2023. several co-accused persons have been granted bail by this Court as well as co-ordinate Benches of this Court.

Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case as well as period of custody, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail in connection with Muffasil P.S. Case No. 345 of 2022 on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Begusarai.
