Petitioner apprehends arrest in a case registered for the offences punishable under Sections 302, 120(B) of the Indian Penal Code and Section 27 of Arms Act. As per prosecution case, all the F.I.R. named accused persons including this petitioner, under conspiracy, committed murder of the son of the informant.

Learned counsel appearing for the petitioner submits that the petitioner is innocent and his name has been transpired in the present case on the basis of suspicion. The only material that has come against the petitioner is that he provided financial help to the shooters. But there is no whisper about how the

He next submits that from perusal of the F.I.R., it is apparent that informant is claiming to be eye witness of the occurrence but has not named the petitioner in the F.I.R. to be present at the place of alleged incident. Petitioner claims clean antecedent.

Considering the aforesaid facts and circumstances, let the above named petitioner in the event of his arrest/surrender before the court below within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate, 1st Class, Samastipur in Musarigharari P. S. Case No. 129 of 2020, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
