JUSTICE VINOD KUMAR SINHA ORAL ORDER 16-01-2020 This is an application for grant of anticipatory bail in connection with Bihiya P. S. Case No. 196 of 2017, disclosing offences under Sections 366(A), 504/34 of the Indian Penal Code.
As per F.I.R., allegation against the petitioner is that petitioner has kidnapped the minor daughter of the informant. Submission of the learned counsel for the petitioner is that as a matter of fact, victim girl is residing with one Brajesh Kumar and an agreement was reached to marry them after she attained her majority, on which brother of the girl and father of Brajesh Kumar are witnesses. Mutual agreement prepared by Officer-in-charge, Hirapur Police Station, which is annexed as Annexure-3 to this application.

Having heard both sides, considering the above
Patna High Court CR. MISC. No.70355 of 2019(2) dt.16-01-2020 2/2 submissions, this application is disposed of with a direction to the petitioner to surrender before the learned court below within a perid of three weeks from the date of receipt of certified copy of this order, on surrender, the petitioner shall be released on provisional bail to the satisfaction of court below and after release he will produce the copy of Annexure-3 before the Investigating Officer to verify the authenticity of Annexure-3. If, after verification the same was found true. Once the I.O. verify the authenticity of the same and submit a report before the court below. The learned court below if found the Annexure 3 true, the court below shall confirm the provisional bail of the petitioner, otherwise, he has to surrender and pray for regular bail.
