In this case, the petitioners are apprehending their arrest in connection with Belaganj P.S. Case No. 337 of 2017 registered for the offences under Section 379 of the Indian Penal Code and under Rule 4/21 of the M.D.R. Act, 1957 and under Rule 13/75 of B.M.M. Rule, 2017.

A truck, bearing Registration No. BR-25G-5173, loaded with the sand was intercepted making allegation of illegal transportation of sand, but the Challan, issued by the Mining Department, Govt. of Bihar, showing that the petitioners have

Patna High Court Cr.Misc. No.6055 of 2018 (3) dt.06-02-2018 2/2 valid license for lifting sand.

Looking to the entire facts and circumstances of the case, let the petitioners, above named, in the event of their arrest or surrender before the court below, within a period of four weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-XI, Gaya, in connection with Belaganj P.S. Case No. 337 of 2017, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
