The petitioners seek pre-arrest bail in connection with Daudnagar P.S. Case No. 198 of 2019, registered under Sections 147, 149, 341, 323, 325, 307 and 504 of the Indian Penal Code. The accusation is that on 26.07.2019, the informant, Gorakh Paswan, was engaged in preparing the hut, at that time, Ramji Paswan (petitioner no. 1) started to drain out the water through that place in which grass, kept there for preparing hut, got wet, then, informant made protest on which petitioners started to abuse and Ramji Paswan ordered to his sons, Rajesh Paswan (petitioner no. 2), Ramesh Paswan (petitioner no. 3) Raushan Kumar and Raju Kumar to cause assault. At that time, Ramji Paswan tried to press his neck and his sons made attempt to cause assault. When family members reached there, then,
Patna High Court CR. MISC. No.74158 of 2019(2) dt.06-02-2020 2/2 they were also assaulted. At that time, his daughter, Babita Devi, was also assaulted by pelting brick by Raushan Kumar. Submission is that petitioner no. 1 and informant are own brother and petitioners 2 and 3 are new of the informant. Due to family dispute hot talk exchanged and due to ulterior motive the present case has been filed. More over, the injuries found on the persons of the informant, are simple in nature. Having regard to the facts and circumstances of the case, let the petitioners, above named, in the event of surrender/arrest, within a period of four weeks from today, in connection with Daudnagar P.S. Case No. 198 of 2019 shall be released on bail on furnishing bail bonds of Rs.10,000/- (rupees ten thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Aurangabad, or the successor Court subject to the conditions as laid down under Section 438(2) Criminal Procedure Code.
