The petitioner seeks bail in connection with Ara Muffasil P.S. Case No.165 of 2019, registered for the offence under Section 366(A)/34 of the Indian Penal Code. The accusation is that in the evening of 29.05.2019, the daughter of the informant, namely, Puja Kumari, aged about 16 years, had gone to attend call of nature outside of her house with her Maami Meenu Devi and while she was returning, accused Govind along with one another accused person came on a motorcycle and boarded her on the said motorcycle and took her away for the purpose of marriage.

Submission is that in fact, being love affairs in

No.71276 of 2019(2) dt.27-11-2019 2/2 between the daughter of the informant and the petitioner, the daughter of the informant left her parental house and called the petitioner on mobile. On call, the petitioner came and took her away. Further submission is that the victim has been recovered and her statement was recorded under Section 164 Cr.P.C., in which she has stated that she herself left her parental house and called the petitioner and married with the petitioner in a Dharmnath Temple. The victim further stated that she was living with the petitioner in Chapra as husband and wife. It is submitted that at the time of recording statement under Section 164 Cr.P.C. the age of the victim was assessed as 19 years. The petitioner is in custody since 05.09.2019.

Having considered the facts and circumstances of the case, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhojpur at Ara in connection with Ara Muffasil P.S. Case No.165 of 2019.
