JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 11-07-2023 Although no counter affidavit has been filed on behalf of the Aryabhatta Knowledge Univeristy (hereinafter referred to as the 'Univeristy') in terms of the order dated 10.02.2023 passed by this Court, at this stage, learned counsel for the petitioner has informed this Court that the petitioner has got an alternative statutory remedy of appeal before the Chancellor of the University against the impugned order.

Learned counsel submits that he may be permitted to withdraw this application with liberty to seek his remedy before the learned Appellate Authority in accordance with law. Permission is granted.

This application is being disposed of with liberty to the petitioner to avail his alternative statutory remedy in

Patna High Court CWJC No.1123 of 2023(3) dt.11-07-2023 2/2 accordance with law.

If any question of limitation would arise for consideration, the same will be considered keeping in view that the petitioner was pursuing his remedy under some bonafide belief before this Court.
