The petitioner is apprehending his arrest in connection with Dulhin Bazar P.S.Case No.306 of 2017 registered for offences punishable under Sections 302, 120(B)/34 of the Indian Penal Code and Section 27 of the Arms Act.

Allegation against the petitioner and 14 other accused persons is that they came and surrounded the deceased and one Dinesh Mahto fired on him causing his death.

Submission of the learned counsel for the petitioner is that no specific allegation has been attributed against the petitioner and specific allegation is against Dinesh Mahto of firing. Further submission is that though he is accused in four other cases, but those cases relate to the land dispute.

Patna High Court Cr.Misc. No.23640 of 2018 (2) dt.20-04-2018 2/2 Heard learned A.P.P. also, who has opposed the prayer for bail.

Having heard both sides and in view of allegation as well as the fact that he has criminal antecedent , I am not inclined to grant anticipatory bail to the petitioner, rather let the petitioner surrender before the learned court below within a period of four weeks from the date of receipt of the order and make prayer for regular bail, which will be considered on its own merit without being prejudiced by the order of this Court.
