Petitioner apprehends his arrest in connection with Jamhor P.S. case no. 93 of 2017, registered under Sections 379 and 411 of the I.P.C and Sections 3,4, and 5 of the Bihar Minerals (Prevention of Illegal Mining, Transportation and Storage) Rules, 2003.
Learned counsel submits that only the tractor owned by the petitioner was found present there. He was not allegedly present when the sand was being lifted. It is further submitted that sand was laden on the tractor owned by the petitioner. However, for securing the privilege of anticipatory bail petitioner is ready and willing to deposit some amounts as directed by the Court.

No.3140 of 2018(2) dt.16-01-2018 2/2 Considering the aforesaid submissions, let the petitioner, named above, in the event of his arrest or surrender before the Court below within a period of four weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Aurangabad, in connection with Jamhor P.S. case no. 93 of 2017, subject to the condition as laid down under Section 438(2) of the Code of Criminal Procedure with further following conditions:- (I) One of the bailors shall be the own/close family member of the petitioner.
(ii) Along with the bail bonds petitioner shall produce receipt showing deposit of a sum of Rs. 3,500/- (Three thousand and five hundred) in the Nazarat of the Civil Court. It is clarified that deposit so made shall be without prejudice to the right and contention of the petitioner in the case. (Kishore Kumar Mandal, J) shyambihari/- U T
