2. The petitioner seeks bail in a case registered for the offence punishable under Sections 103(1), 238, 303(2) and 3(5) of the Bharatiya Nyaya Sanhita, 2023.
3. As per prosecution case, the informant alleged that on 30.05.2025 his son received a phone call and went outside but did not return, later on his dead body was found.
4. It is submitted by learned counsel appearing on behalf of the petitioner that petitioner is quite innocent and has committed no offence. Petitioner is not named in the F.I.R. and the name of the petitioner has surfaced during investigation, on the basis of confessional statement of co-accused, namely, Sonu. Save and except confessional statement there is no material to
Patna High Court CR. MISC. No.75461 of 2025(2) dt.14-11-2025 2/2 indicate his complicity in the occurrence. Petitioner has no criminal antecedent and he is in custody since 05.06.2025. He further submits that charge sheet has already been submitted in this case.
5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner.
6. Considering the facts and circumstances of the case, the prayer for grant of bail to the petitioner is allowed. Let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-VII, Darbhanga in connection with Baheri P.S.
