JUSTICE SHIVAJI PANDEY ORAL ORDER 02-02-2018 Heard learned counsel for the petitioners and learned counsel for the State.
In this case, the petitioners are seeking anticipatory bail in connection with Chandan (Anandpur O.P.) P.S. Case No. 141 of 2016, registered for the offence punishable under Sections 147, 148, 149, 341, 323, 324, 307, 379, 452, 427, 504 and 506 of the Indian Penal Code.
Allegation has been made that on 24.11.2016 the accused persons including the petitioner no.1 has surrounded the house of the informant and assaulted him vandalizing his house.
Patna High Court Cr.Misc. No.5970 of 2018 (2) dt.02-02-2018 2/2 Specific allegation has been made against the petitioner no.1 to have caused injury by iron rod. No specific allegation has been made against rest of the petitioners.
Learned counsel for the petitioners submits that there is case and counter case from both the sides and the incident has happened on account of land dispute. Looking to the aforesaid facts, let the above-named petitioner nos.2 to 11, be released on anticipatory bail in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Banka, in connection with Chandan (Anandpur O.P.) P.S. Case no.141 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
So far as the bail of petitioner no.1 is concerned, the same is rejected. However, liberty is given to move before the Court below for regular bail.
