The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 302, 120(B), 201/34 of the Indian Penal Code.

As per the prosecution case, this petitioner took away motorcycle from the house of informant which was used in fleeing away, both son of informant and daughter of Kamlesh Singh.

It is submitted that there is no allegation against this petitioner that he called the deceased or he was seen with the deceased. It is a case of suicide. Dead body was found hanging with a tree. Only allegation against this petitioner is that he took away the motorcycle from the house of informant.

No.638 of 2023(2) dt.07-04-2023 2/2 Considering the facts aforesaid, the petitioner abovenamed, in the event of his arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Gopalganj in connection with Bhorey P.S. Case No. 173 of 2022, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
