1. Heard learned counsel for the petitioners and learned APP for the State.
2. The petitioners seek bail in anticipation of their arrest in a case registered for the offences punishable under Sections 127(1), 115(2), 118(1), 109, 76, 303(2), 351(2), 352, 3(5) of the B.N.S.
3. The learned counsel for the petitioners submits that the petitioners are persons with clean antecedent. It is next submitted that name of the husband of the informant is Ranjit Kumar and father of Ranjit Kumar is Nand Lal and Nand Lal is own brother of Shiv Lal Sah (petitioner no.2), as such, petitioner no.2 is cousin father in-law of the informant and petitioner no.1
Patna High Court CR. MISC. No.75877 of 2025(2) dt.17-12-2025 2/3 is her cousin brother in-law. It is next submitted that the parties are having dispute relating to property. It is further submitted that informant alleges that petitioner no.1 and Pawan entered her house and tried to put colour, but on alarm, they left and came after sometimes with other accused persons and Polo assaulted her husband causing injury on head requiring ten stitches and Pawan assaulted Praveen by gada causing injury on head requiring five stitches, while Sameer acted inappropriately with her and kicked in her abdomen endangering her pregnancy on account of internal bleeding and Mantu broke her mobile worth Rs.30,000/-, on alarm, villagers gathered and accused fled.

It is submitted that from perusal of the allegation as alleged in the FIR, it would manifest that informant has tried to portray a picture that Mantu along with Pawan on the eve of Holi forcefully entered her house with a view to play Holi and on alarm, they fled, thereafter came back with other accused persons and assaulted her family members, but then, has very wisely concealed her relationship with Mantu, who is her cousin brother in-law. It is further submitted that mother of Mantu instituted Janta Bazar P. S. Case No.59 of 2025 against the informant and her side alleging that on account of dispute relating to property, the occurrence is alleged to have taken

It is also submitted that as far as petitioners in the anticipatory bail application are concerned, the allegation against petitioner no.2 is general and omnibus in nature while against Mantu, the allegation is ornamental. It is also submitted that petitioners are not criminals.
5. Learned A.P.P. opposes the anticipatory bail application.

Considering the submissions made by the learned counsel for the petitioners, the petitioners, above-named, in the event of their arrest or surrender before the learned Court below within a period of six weeks, are directed to be released on anticipatory bail on their furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Trial Court where the case is pending/successor Court in connection with Janta Bazar P. S. Case No.58 of 2025, subject to the conditions laid down under Section 482(2) of the B.N.S.S.
7. The application stands allowed.
