Supplementary affidavit has been filed today in the Court stating that one complaint case is pending against the petitioners.

The petitioners apprehend their arrest in Singheshwar P.S. Case No. 115 of 2017 instituted for the offence under Sections 302, 201 and 34 of the Indian Penal Code. It has been submitted that petitioners are mother-inlaw and Dewar of the deceased. They have been living separate from the husband of the deceased. Petitioners have no concern with the affairs of the daughter of the informant and her husband.

Patna High Court Cr.Misc. No.4629 of 2018 (4) dt.28-03-2018 2/3 Case diary has been received.

Learned counsel for the petitioner has submitted that daughter of the deceased namely Anju Kumari has stated in paragraph-7 and another witness Panchu Yadav in paragraph-6 of the case diary that the deceased had hanged herself. Similar statement has been made by other witnesses in the case diary. Considering the facts and circumstances of the case, prayer for anticipatory bail of the petitioners is allowed. In the event of surrender/arrest of the petitioners, named above, within six weeks from today, in connection with Singheshwar P.S. Case No. 115 of 2017, they shall be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Madhepura, subject to the conditions as laid down under Section 438 (2) Cr. P.C.

Patna High Court Cr.Misc. No.4629 of 2018 (4) dt.28-03-2018 3/3 prosecution will be at liberty to move for cancellation of bail of the petitioners.
