JUSTICE RAKESH KUMAR ORAL ORDER 23-03-2018 Heard Sri Rang Nath Choubey, learned counsel for the petitioner and learned Addl. Public Prosecutor. The sole petitioner, apprehending his arrest in Bikramganj P.S. Case No.134 of 2017 registered for the offence under Section 366 A of the Indian Penal Code, has prayed for grant of bail, in the event of his arrest or surrender. Learned counsel for the petitioner submits that the petitioner has falsely been implicated in the present case. He further submits that of course, the victim in her statement recorded under Section 164 of the Code of Criminal Procedure, has disclosed her age as 13 years, but during medical examination, the doctor has assessed her age as 16-17 years. Accordingly, a prayer has been made for grant of anticipatory bail.

Patna High Court Cr.Misc. No.4738 of 2018(3) dt.23-03-2018 2/2 However, after going through the F.I.R. as well as the statement of the victim girl recorded under Section 164 of the Code of Criminal Procedure, I do not find any ground to extend the privilege of anticipatory bail.

The petition stands dismissed.
