2. This is the second attempt of the petitioner in connection with S.Tr. No. 608 of 2023 arising out of Mahua P.S. Case No. 225 of 2023 registered for the offence under Sections 363, 365, 498(A), 506/34 of the Indian Penal Code and later Section 302 of the Indian Penal Code was also added.

3. As per the prosecution case, the petitioner is the husband of the deceased.

4. In compliance of this Court's order dated 18.12.2024, the report has come which shows that no witness has been examined, though charge has been framed on 12.10.2023.

5. Considering the facts of the case, the period of custody and also the fact of delay in trial, this application is allowed.

6. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned ADJ-VII, Vaishali at Hajipur/concerned Court below in connection with S.Tr. No. 608 of 2023 arising out of Mahua P.S. Case No. 225 of 2023.

7. As a condition of this order, the petitioner, after being released on bail is directed to co-operate in the trial either by appearing personally or through his lawyer in the trial Court on each and every date fixed by the trial Court. Non-compliance of the condition will result in cancellation of the bail bonds of the petitioner.
