In this case, the petitioners are seeking anticipatory bail in connection with Pirbahore P.S. Case No.472 of 2017, registered for the offence punishable under Sections 147, 148, 149, 323 and 353 of the Indian Penal Code.

As per the F.I.R. the informant is the driver of Government boat. While he was going to purchase the petrol for the boat one Scorpio vehicle came with reckless driving and dashed a person and fled away. It is further alleged that on the

No.19138 of 2018(2) dt.06-04-2018 2/3 same day at about 9:30 pm. the petitioners and others came and abused the informant and told that they had made the said accident with Scorpio vehicle and they started assaulting the informant, causing head injury. In the meantime, the Police intervened and he was taken to the P.M.C.H. After discharging from the hospital, the instant case has been lodged by the informant.

Learned counsel for the petitioner submits that occurrence has taken place on 01.09.2017, F.I.R. has been lodged on 04.09.2017 and the case was remitted to the Court on 06.09.2017. He further submits that there is a delay in lodging the F.I.R. and remitting the case to the Court and at the same time no assertion has been made that which part of the body of the informant was assaulted by these petitions. Looking to the facts and circumstances of the case, let the above-named petitioners be released on anticipatory bail in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Patna, in connection with Pirbahore P.S. Case no.472 of 2017, subject to the conditions as
