1. Heard the parties.
2. Petitioner seeks regular bail in connection with Saraiya P.S. Case No. 88 / 2024 dated 16.02.2024 registered under Section 341, 323, 324, 307, 302, 379, 504, 506, 34 of the I.P.C. The anticipatory bail application of the petitioner was rejected earlier vide order dated 20.11.2024 passed in Cr. Misc. No. 77039 of 2024.
3. The prosecution case in short is that on 08.02.2024 in the night while the informant went to take soil from the Government pond, in the meanwhile, the petitioner started abusing her. When the informant's father-in-law came for her rescue, the co-accused / Arun Sahani attacked him with knife on his neck. It has further been alleged that petitioner along with other F.I.R. named accused persons assaulted the informant and

Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case only because he happens to be the father of co-accused / Arun Sahani, who assaulted the deceased by means of knife on his neck due to which the deceased died. She next submits that both the parties are agnates and entire family members have been made accused in this case due to land dispute. Further submission is that the cause of death as appears from the post-mortem report discussed in the impugned order is that the deceased died due to injury caused by knife and the allegation of assault by knife is upon the co-accused Arun Sahani only.

Regard being had to the submissions made by the parties, taking into consideration the fact that specific allegation of assault on the neck of the deceased is upon the co-accused Arun Sahani, the cause of death as mentioned in the post mortem report is that the deceased died due to hemorrhage and shock caused by hard and blunt substance on his neck and the petitioner is in custody since 11.04.2024 having no criminal antecedent, as such, I am inclined to grant regular bail to the petitioner.

6. Let the petitioner be released on regular bail on furnishing bail bond of Rs. 10,000 /- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate- IV, West Muzaffarpur in connection with Saraiya P.S.
