2. The petitioner seeks bail in a case registered for the offence punishable under Sections 302, 201, 120B and 34 of the Indian Penal Code.
3. The informant, namely, Kajal Kumari alleged that on 01.09.2023 petitioner came and took the husband of the informant with him, but he (informant's husband) did not return and later, on 03.09.2023, she came to know about one dead body and on reaching there the informant saw dead body of her husband.
4. Learned counsel for the petitioner submits, it is a circumstantial evidence. As per the F.I.R., the deceased was last seen with this petitioner. Save and except this, there is no cogent
Patna High Court CR. MISC. No.75875 of 2025(2) dt.14-11-2025 2/2 material against this petitioner. Petitioner is in custody since 29.08.2025. Charge-sheet has been submitted.
5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner.
6. Considering the nature of accusation and period of custody, the prayer for grant bail of to the petitioner is allowed.
7. Accordingly, let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Rosera in connection with Bibhutipur P.S. Case No. 350 of 2023.
