The petitioner seeks regular bail in connection with Risiup PS case no. 82 of 2019 instituted for the offences punishable under Sections 354 (A), 506/34 of Indian Penal Code and 11 POCSO Act.
The allegation is regarding the accused persons including the petitioner herein having misbehaved with the informant when she had come out of her school and had also threatened her with dire consequences including sexual assault, in case she did not heed to the wishes of the petitioner. The learned counsel for the petitioner has submitted that a bare perusal of the FIR would show that false allegations have been levelled against the petitioner and infact, there is no

It is further submitted that the petitioner is having a clean antecedent and has already been suitably punished, inasmuch as he is languishing in custody since 06.09.2019.
The learned counsel for the informant has vehemently opposed the prayer for bail.
Having regard to the facts and circumstances of the case, the abovenamed petitioner is directed to be released on regular bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.D.J. 1st- cum-Special Judge, POCSO, Aurangabad in connection with Risiup PS case no. 82 of 2019.
