2. The petitioner apprehends his arrest in a case registered for the offence under Sections 25(1-b), 26, 35 of the Arms Act.
3. As per the prosecution case, 50 live cartridges has been recovered from the possession of co-accused Dhiraj Kumar Giri, who disclosed the name of other co-accused persons and when police raided the house of co-accused Rakesh Kumar, huge quantity of arms & ammunition were recovered and coaccused Rakesh Kumar stated that said arms & ammunition were supplied by this petitioner and co-accused Randhir Kumar.
4. It is submitted on behalf of petitioner that no incriminating article or any arms & ammunition has been recovered from the possession of petitioner and he has been made accused in this case only on the basis of confessional
Patna High Court CR. MISC. No.79695 of 2023(2) dt.10-01-2024 2/2 statement of co-accused, who was apprehended with arms & ammunition.
5. Learned A.P.P. for the State has opposed the prayer for anticipatory bail.
6. Considering the aforesaid facts and circumstances, in the event of arrest/surrender within a period of six weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Biharsharif, Nalanda in connection with Giriyak (Pawapuri) P.S. Case No. 201 of 2023, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
