JUSTICE SHIVAJI PANDEY ORAL ORDER 05-02-2018 Heard learned counsel for the petitioners and learned counsel for the State.
In this case, the petitioners are seeking anticipatory bail in connection with Mohiuddin Nagar P.S. Case No.167 of 2017, registered for the offence punishable under Sections 304(B)/34 of the Indian Penal Code.
The petitioner no.1 is the father-in-law and petitioner no.2 is the mother-in-law of the victim. Allegation has been made that the petitioners and other family members used to demand dowry and when the demand could not be fulfilled the accused persons poured kerosene oil and set her ablaze.
Patna High Court Cr.Misc. No.5961 of 2018 (2) dt.05-02-2018 Looking to the nature of allegation and relationship between the victim and present petitioners, this Court is not inclined to grant anticipatory bail to the petitioners. Accordingly, the prayer for bail is rejected. However, if the petitioners surrender before the Court below within four weeks from today and pray for regular bail, the same will considered by the Court below and pass appropriate order on merit without being influenced by the order of this Court.
