The petitioner apprehends his arrest in Triveniganj P.S. Case No. 316 of 2022, registered for the offences punishable under Section 379 of the Indian Penal Code. FIR was lodged against unknown for theft of motorcycle of informant.

It is submitted that petitioner is not named in the FIR. Name of petitioner transpired in this case during course of investigation. No incriminating article has been recovered from possession of the petitioner.

Counsel for State opposed the prayer for bail and submitted that stolen motorcycle has been recovered from possession of this petitioner.
