The petitioner seeks bail in connection with Parwalpur P.S. Case No. 234 of 2019 registered under Sections 379, 420, 467 and 468/34 of the Indian Penal Code. It is contended by the learned counsel for the petitioner that though the alleged occurrence is said to have taken place on 21.09.2019 at 11.30 a.m., an information in this regard was given to the police on the next date i.e. on 22.09.2019 at 7.30 p.m.. There is no plausible explanation for the delay caused in institution of the FIR. It is further contended that the petitioner is the driver of the vehicle bearing registration no.BR01GC-1751 and he had no knowledge of the materials loaded on the same because the co-accused Upendra Kumar had

Considering the nature of allegation, the defence taken by the petitioner as also the statement made in para 3 of the petition that the petitioner has got no criminal antecedent, he is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-I, Hilsa (Nalanda) in connection with Parwalpur P.S. Case No.234 of 2019.
