In this case, the petitioners are seeking anticipatory bail in connection with Sursand P.S. Case No.177 of 2016, registered for the offence punishable under Sections 341, 323, 354, 379, 504 and 506/34 of the Indian Penal Code. Allegation has been made against the petitioners to have assaulted the informant. It has also been alleged that petitioner no.1 was in intoxicated condition and misbehaved with her and petitioner nos. 1 and 2 tried to outrage the modesty of the informant.
It has been submitted that allegations are false as no male will act in such manner in presence of female.
Patna High Court Cr.Misc. No.6104 of 2018 (2) dt.05-02-2018 2/2 Looking to the nature of allegation, let the abovenamed petitioners, be released on anticipatory bail in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) each with two sureties of the like amount each to the satisfaction of Judicial Magistrate, Pupri at Sitamarhi, in connection with Sursand P.S. Case No.177 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
