JUSTICE VINOD KUMAR SINHA ORAL ORDER 17-01-2020 Petitioners seek bail in anticipation of their arrest in connection with Forbesganj P.S. Case No. 40 of 2019 registered for the offences punishable under Sections 448, 341, 323, 324, 354B, 379 and 427/34 of the Indian Penal Code.

As per prosecution case, petitioners entered inside the

Patna High Court CR. MISC. No.74367 of 2019(2) dt.17-01-2020 2/2 house of the informant and tried to outrage her modesty and also torn her clothes.

Submission of learned counsel for the petitioners is that FIR was lodged after six months of the occurrence which shows falsity of the case and as a matter of fact informant's side also caused head injury to one Samshul and due to which some occurrence took place and taking advantage of the same making allegation of outraging modesty the present case has been filed. Heard learned APP also.

In view of above facts and circumstances, let petitioners, in the event of surrender, be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Araria, in connection with Forbesganj P.S. Case No. 40 of 2019, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and further condition is that one of the bailors of the petitioners shall be a local person having sufficient immoveable property within the jurisdiction of the court concerned.
