JUSTICE MOHIT KUMAR SHAH ORAL ORDER 30-03-2018 Heard the learned counsel for the petitioner and the learned A.P.P. for the State.
This is an application for grant of anticipatory bail in connection with Siwan Town P.S. Case No. 514 of 2017 registered for offences punishable under Sections 420, 467, 468 and 471 of the Indian Penal.
The allegation in the present case is that the caste certificate of the petitioner herein was sent to the District Welfare Officer, Siwan for the purposes of canceling the caste certificate of the petitioner herein and it was found that the same is a forged caste certificate.
The learned counsel for the petitioner submits that a bare reading of the FIR would show that no allegation whatsoever
Patna High Court Cr.Misc. No.6366 of 2018 (4) dt.30-03-2018 2/2 has been levelled against the petitioner herein of either tempering or forging the caste certificate, hence this is a fit case for grant of anticipatory bail. The petitioner is said to be having a clean antecedent.
Having regard to the facts and circumstances of the case, I deem it fit and proper to admit the petitioner herein to the privilege of anticipatory bail in the event of his arrest or surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Siwan in connection with Siwan Town P.S. Case No. 514 of 2017 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
