The petitioner apprehends his arrest in Amnaur PS Case No. 233 of 2022 registered for the offences punishable under Section 30(a) of the Bihar Prohibition and Excise Act. 334 litres of country made liquor has been recovered from tempo of this petitioner.

It is submitted that nothing has been recovered from conscious possession of this petitioner and he has been made accused in this case merely because he is owner of tempo in question. The vehicle of this petitioner was used in transporting illicit liquor without his knowledge and consent. Petitioner claims clean antecedent.

Counsel for State however vehemently opposed the

Patna High Court CR. MISC. No.2278 of 2023(3) dt.04-04-2023 2/2 prayer for bail.

Considering the fact that huge quantity of liquor has been recovered from a tempo of which this petitioner is registered owner, I am not inclined to enlarge the petitioner above-named on anticipatory bail. Accordingly, the same is rejected.
