JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 04-12-2019 Heard learned counsel for the petitioner, learned counsel for the State and learned counsel for the informant. The petitioner seeks bail in connection with Nokha P. S. Case No. 237 of 2017 registered under Sections 406, 420 and 506 read with Section 34 of the Indian Penal Code. Learned counsel for the petitioner submitted that the allegation made in the FIR is predominantly of a civil nature. The informant has claimed that he has supplied paddy amounting to Rs.63 lakh, but he has not produced a chit of paper regarding supply of paddy. The petitioner in custody since 20.06.2019 and having got roots in the society, he is not likely to abscond or tamper with the evidence.

Considering the nature of allegation and the submission made above, the petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand only) with two sureties of the like amount each to the satisfaction of learned Sub-Judge-IV-cum-Additional Chief Judicial Magistrate, Rohtas at Sasaram in connection with Nokha P. S. Case No. 237 of 2017.
