The petitioner seeks regular bail in connection with Tajpur (Waini O.P.) P.S. Case No. 458 of 2023 instituted for the offences punishable under Sections 457 and 380 of the Indian Penal Code .

It is a case of theft of 107 bags of wheat from the godown of the informant.

Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case. He further submits that one mobile phone of the petitioner and only 35 kg. of wheat have been recovered from the possession of the petitioner and the wheat is in small quantity as alleged in the FIR

Patna High Court CR. MISC. No.79731 of 2023(2) dt.08-12-2023 2/2 and petitioner is in judicial custody since 07.09.2023 Learned APP for the State opposes the prayer for bail of the petitioner.

Considering the facts and submissions of the petitioner, let the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of CJM, Samastipur in connection with Tajpur (Waini O.P.) P.S. Case No. 458 of 2023.
