JUSTICE VINOD KUMAR SINHA ORAL ORDER 06-01-2020 This application, for grant of anticipatory bail, arises out of Agiaon (G) P.S. Case No. 114 of 2019, disclosing offences under Sections 302/34 of the Indian Penal Code and Section 27 of the Arms Act.

As per F.I.R., it is alleged that on the order of petitioner, co-accused, who are his sons, fired on the uncle of the informant causing injury to him and later on he succumbed to his injuries.

Submission of learned counsel for the petitioner is that during investigation none of the witnesses have supported the allegation that on the order of petitioner, co-accused persons fired on the uncle of informant and petitioner has been made accused in this case only because he happens to be father of coaccused persons.

Patna High Court CR. MISC. No.69968 of 2019(3) dt.06-01-2020 2/2 Learned A.P.P. could not controvert the above submission of learned counsel for the petitioner. Having heard both sides, considering the submission, as above, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate -XI, Bhojpur, Ara, in connection with Agiaon (G) P.S. Case No. 114 of 2019, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
