The petitioner seeks bail in anticipation of his arrest in connection with Jagdishpur P.S. Case No. 57 of 2017 dated 03.03.2017 instituted for the offences under Sections 420, 406 and 409 of the Indian Penal Code.

The petitioner, in his capacity as head clerk (pension) is alleged to have failed to deposit approximately Rs. 38 lakhs which was given to him for distributing as pension. Learned counsel for the petitioner has drawn the attention of this Court to Annexure- 3 and 4 which indicate that the balance amount of Rs. 38 lakhs which was not deposited by the petitioner has already been deposited in the bank and the BDO

Patna High Court Cr.Misc. No.4221 of 2018 (2) dt.01-02-2018 has certified about the correctness of the aforesaid statement. Let the petitioner above named be released on bail in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, on furnishing bail bond of Rs. 10,000/- (Rs. Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate XIth, Bhojpur at Ara in connection with Jagdishpur P.S. Case No. 57 of 2017, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
