JUSTICE RAKESH KUMAR ORAL ORDER 12-02-2018 Heard Shri Radhe Shyam Sharma, learned counsel, assisted by Shri Sunil Kumar, learned counsel for the petitioners and Shri Damodar Prasad Tiwary, learned Additional Public Prosecutor.
Four petitioners, apprehending their arrest in connection with Biraul P.S. Case No. 288 of 2017 registered for the offence under Sections 147, 148, 341, 323, 324, 337, 307, 379, 504 and 506 of the Indian Penal Code, 1860 have prayed for grant of bail in the event of their arrest or surrender. Learned counsel for the petitioners by way of referring to the FIR submits that in the occurrence allegation against the petitioners is that they used fists and slaps. He further submits that some other accused persons against whom also there was
Patna High Court Cr.Misc. No.6751 of 2018(2) dt.12-02-2018 2/2 allegation of using fists and slaps have already been extended the privilege of anticipatory bail. Accordingly, on the ground of parity a prayer has been made for extending the same privilege to the petitioners.
Besides hearing learned counsel for the parties, I have also perused the materials available on record and after going through the same, the court is of the opinion that it is a fit case for extending the privilege of anticipatory bail. Accordingly , in the event of arrest or surrender within a period of six weeks from today, let the aforesaid four petitioners Ranjeet Ram, Binde Ram, Pancha Ram and Umesh Ram be enlarged on bail on furnishing bail bonds of Rs. 10,000/- ( rupees ten thousand ) each with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Biraul / concerned court in connection with Biraul P.S. Case No. 288 of 2017 subject to the conditions as contemplated under Section 438 (2) of the Code of Criminal Procedure, 1973. (Rakesh Kumar, J) praful/- U T
