The petitioners seek regular bail in connection with Mansahi P.S.Case No.85 of 2019 registered for offences punishable under Sections 30(a) and 37(b) read with Section 13 of the Bihar Prohibition and Excise Act, 2016 . Allegation against the petitioners is about recovery of 10 ltrs. of liquor each from the petitioner nos. 1 and 2.. Submission of the learned counsel for the petitioners is that they have been falsely implicated in this case. They are in custody for more than three months. Charge sheet has already been submitted. There is no chance of tampering with the evidence.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioners, above named, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of the learned Addl. District and Sessions Judge II cum Special Judge, Excise Act, Katihar in connection with Mansahi P.S.Case No.85 of 2019 with condition to co-operate in disposal of the trial.. With the aforesaid observation, this application is allowed.
