Petitioner apprehends his arrest in connection with Mashrakh P.S.Case No. 342 of 2017 registered for the offences punishable under Sections 413 and 414 of the Indian Penal Code. Allegation as per FIR is that one stolen motorcycle was recovered from co-accused and on his confession another stolen motorcycle was recovered from the house of the petitioner. Submission of learned counsel for the petitioner is that petitioner has no criminal antecedent and he has falsely been implicated at the instance of co-accused.

Having heard both sides and in the facts and circumstances, I am not inclined to grant anticipatory bail to the
Patna High Court Cr.Misc. No.11829 of 2018 (3) dt.04-04-2018 2/2 petitioner. Prayer is rejected.
However, petitioner should surrender and pray for regular bail, which shall be considered on its own merit. With the above observation, this application is dismissed. (Vinod Kumar Sinha, J) spal/- U
