JUSTICE VINOD KUMAR SINHA ORAL ORDER 11-12-2019 This application, for grant of anticipatory bail, arises out of Sikrahata P.S. Case No. 87 of 2019, disclosing offences under Sections 414 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act, 2018. Allegation is of recovery of huge quantity of liquor from the pick-up Van and Bolero vehicle parked beside the house of co-accused Jhulan Singh and further there was also recovery of liquor from the house of said Jhulan Singh and it is alleged that petitioner and others are also engaged in sell and purchase of liquor.

Submission of learned counsel for the petitioners is that he has no criminal antecedent and has falsely been implicated in this case and there is nothing to show as to what was the source of information.

Patna High Court CR. MISC. No.71000 of 2019(3) dt.11-12-2019 2/2 Learned A.P.P. could not controvert the above submission, though case diary is available with him. Having heard both sides, in view of the above facts, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge -IV-cum-Special Judge, Excise, Bhojpur at Arra, in connection with Sikrahata P.S. Case No. 87 of 2019, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
