The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 376, 354(B), 354 and other allied sections of the Indian Penal Code. As per the prosecution case, all the accused persons including petitioner having armed with lathi, danda abused and assaulted the informant. Petitioner also tried to commit rape with informant.

It is submitted that from bare perusal of FIR, it is apparent that land dispute is going on between the parties. Petitioner is none else than own cousin brother of informant. Petitioner has been falsely implicated in this case due to land dispute. Moreover, there is no injury report on record. Petitioner

Considering the facts aforesaid, the petitioner abovenamed, in the event of his arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate 4th, Siwan in connection with Siwan Muffasil (Dhanouti OP) P.S.
