====================================================== CORAM: HONOURABLE JUSTICE SMT. ANJANA MISHRA ORAL ORDER 26-11-2019 Heard learned counsel for the petitioners and learned A.P.P. for the State.

The petitioners are apprehending their arrest in connection with Shahpur P.S. Case No. 265 of 2019 for the offence registered under Sections 147, 341, 323, 307, 504, 506, 452 of the Indian Penal Code.

Learned counsel for the petitioners submits that though there is a description of assaults having been made by the petitioners, the injury report does not substantiate and tally with the nature of the allegations which has been made in the FIR. He further submits that all the injuries have been found to be

Patna High Court CR. MISC. No.75448 of 2019(2) dt.26-11-2019 2/2 simple. Hence, the petitioners may be extended the privilege of anticipatory bail.

Learned counsel for the informant is also present to oppose the prayer of the petitioners and submits that the injuries found have been undermined and the case has been found to be true.

Considering the entire facts and circumstances and the fact that the injuries and the allegations are not specific but general and omnibus against the accused persons, let the petitioners, above named, in the event of their arrest or surrender before the court below within four weeks, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten Thousand) each with two sureties of the like amount to the satisfaction of learned Additional Chief Judicial Magistrate I, Danapur, Patna, in connection with Shahpur P.S. Case No. 265 of 2019, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
