KUMAR ORAL ORDER 26-11-2019 Heard learned counsel for the petitioner, learned counsel for the informant and learned counsel for the State. Petitioner, apprehends his arrest in connection with Mahila P.S. Case No. 27 of 2019 registered for the offences punishable under Sections 341, 323, 498(A)/34 of the Indian Penal Code and Section 3/4 of the Dowry Prohibition Act. Informant Bindu Devi alleged that her marriage was solemnized with the petitioner in the year 2018 in which sufficient gifts and cash were given at the time of marriage. However, after marriage she was being tortured for demand of dowry and for non-fulfillment of which she was ousted from her matrimonial house.

Petitioner has no criminal antecedent. Petitioner has filed divorce case no. 71 of 2019 against opposite party no.2 in the Family Court, Bhabhua and thereafter present FIR was lodged. Learned counsel for the informant has opposed the prayer of bail of the petitioner.

Considering the facts and circumstances of the present case, let petitioner, above named, in the event of arrest or surrender within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M. Rohtas at Sasaram, in connection with Mahila P.S. Case No. 27 of 2019, subject to the condition as laid down under Section 438(2) of the Code of Criminal Procedure subject to verification that petitioner has no criminal antecedent. (S.
