In this case, the petitioner is apprehending his arrest in connection with Gopalganj (T) P.S. Case No. 601 of 2017 registered for offences under sections 147, 148, 149, 302, 379, 427, 452, 504, 506 of the Indian Penal Code and Section 27 of the Arms Act.
As per allegation, named and 30-35 unknown accused persons came to the place of the Informant, started removing the hutment and firing indiscriminately, when the objection was raised, accused Bhikhu Yadav and Anandi Pandey shot dead her husband.
Learned counsel for the Informant has submitted
Patna High Court Cr.Misc. No.8980 of 2018(3) dt.19-04-2018 2/3 that the police has recovered 51 empty cartridges from the place of occurrence.
Learned counsel for the petitioner submits that this Court has already granted anticipatory bail to several accused persons, namely, Santosh Yadav @ Santosh Kumar Yadav vide order dated 27.2.2018 in Cr. Misc. No. 10481 of 2018, Dinanath Manjhi vide order dated 26.3.2018 in Cr. Misc. No. 8231 of 2018, Pinki Gupta @ Niraj Kumar vide order dated 6.4.2018 in Cr. Misc. No. 15014 of 2018, Rana Srivastava @ Vikash Kumar Sinha @ Vikash vide order dated 20.2.2018 in Cr. Misc. No. 8819 of 2018 and Narain Shrivastava vide order dated 17.2.2018 passed in Cr. Misc. No. 9425 of 2018.
Looking to the entire facts and circumstances of the case, let the petitioner, namely, Rahul Srivastava @ Dipu Srivastav @ Rahul Sinha, in the event of his arrest or surrender before the court below within a period of four weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gopalganj in connection with Gopalganj (T) P.S. Case No. 601 of 2017, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
Patna High Court Cr.Misc. No.8980 of 2018(3) dt.19-04-2018 3/3 petitioner will cooperate in the investigation and as and when the police will call for him for interrogation, he will present himself, in failure, the prosecution will be at liberty to cancel the bail of the petitioner.
